We all hard about different kind of deeds like Quitclaim deed, Grant Deed, Warranty Deed and there is another kind of deed which is call Ladybird deed. This is also a legal document through which the owner of the property can transfer the property to his or her heirs and at the same time that person will own the property as long as he lives. That means he can sell the property even without notifying the beneficiary. That’s why this deed is also call Enhanced life estate deed.

The Ladybird deed is named after Lady Bird Johnson. This deed is available only a few states like Florida. There are many benefits of a Ladybird Deed. After the death of the owner the beneficiary or the hire named on the deed will be the owner of the property. People use a Ladybird Deed to avoid probate. If the property is sold shortly after the owners death then there will be no capital gain tax for the beneficiary. Even after signing a Ladybird Deed, the granter can take out a mortgage against that property during his lifetime and also gift the property to any other person.

Few people think that using Ladybird Deed can make you ineligible for Medicaid but that is not true. Using a Ladybird Deed does not make you ineligible for Medicaid if you express the Intent To Return. Now the question is it is better than a quitclaim deed? The answer is quite simple. A Ladybird Deed is better then a quitclaim deed in many ways as it allows the owner of the property to take a mortgage or sell the property even after using a Ladybird Deed.

An enhanced life state deed is known as Lady Bird Deed. It is named after Lady Bird Johnson. As per report President Johnson used to transferred property or land to his wife Claudia Lady Bird Johnson by using this type of deed instrument. So that life estate deed became familiar as Lady Bird Deed in America. Nowadays this special deigned instrument is available only in some state like Florida.

An enhanced life state deed is a deed instrument in which the holder of the life estate by sale or gift can transfer the property without getting any concern of the owner of the remainder interest or the heir to whom it is willed this property. The life estate owner can smash the remainder interest by transferring the property because the original owner does not require their permission to sell or gift.

It is not more likely to the traditional Life Estate Deed in which the holder of the life estate cannot transfer more than life interest without consent the remainder interest holder. For this Lady Bird deed capital gains tax is not arise after death selling of this property because it is a life tenant live for their life. The previous owner can also have the right to do almost every thing to this property as like the life estate holder but he or she can not only transfer it to heir. Until the death of the owner the heir has no legal right on this property.

Although it is a safeguard to the property because only the owner may decide to sell and also a financial help to the heir only after the death of the original owner.

A deed means a legal document that is used to transfer real estate property. There are different types of deeds which are used to transfer property according to the situation and needs.
People use quitclaim deed to transfer property among the family members, friends and near and dear ones. Using a quit claim deed means that the person is quitting all the claims on that property. This type of deed is mostly used at the time of divorce or sharing the property among the family members. A quit claim deed does not assures that the title of the property is free from all the liens.

A grant deed assures that the title of the property is free from liens and that is the reason why people like to use a grant deed instead of a quit claim deed for selling or buying property. Warranty deed also assures you that the title is lien free. So one can use a warranty deed in place of warranty deed. A warranty deeds assures the buyer that seller has absolute right to sell the property.

There is one thing common in all the deeds that all kind of deeds need to be notarized and then it should also be recorded in the Recorder’s office in your state as soon as possible after the notarization of the deed to make the deed valid. When you are willing to transfer a property you should take help of an attorney who can help you out to make the deed valid.
